首先,我们要判断自己的产品是否被跟卖:购物车占有率不是100%


其次,要知道如何防跟卖:

① 注册商标(深圳有商标补贴,具体搜“深圳市知识产权专项资金管理办法”),然后到亚马逊上进行备案,备案成功配合test buy进行投诉。

② 产品本身带Logo

③ 包装图片带Logo,并把包装配件图用在Listing附图中

④ 产品拍图中搭配个性赠品

⑤ 不定期修改Listing,在Bullet Point和Description里注明"XXXX is registered Trademark by XXXXX"

   

被跟卖之后不要慌张,找到解决方法:

(1)常用:邮件警告跟卖者

         如果对方回复并下架:OK

         如果对方不回复但是下架:OK

         如果对方不回复/不理会:以买家身份直接进行Test Buy,同时可向AM投诉!投诉链接入口:https://www.amazon.com/gp/help/reports/contact-us(US站为例)


警告邮件模板(可参考下文):要得体,强硬,有理有据!

Dear  “ B ”,


It has come to our attention that “ B ” is using the " A " trademark without license or prior written authorization from " A ".

" A " holds federal trademark registrations in the United States. So  “ B ” listings violate " A " trademark and intellectual property rights. You are also in breach of Amazon’s Participation Agreement.

Therefore, we demand that you immediately remove all listings on Amazon.com in which “ B ”utilizes our trademarks and images protected by copyright.

“ B ” currently has at least one listing on Amazon.com for products that utilize“ A’s” trademarks and/or copyrights without  authorization. See the following ASIN: B001234567

" A " is the only entity authorized to provide authorization to sell its products on Amazon.com. Your listing constitutes a violation of  " A's " trademark rights, copyrights, and Amazon’s Participation Agreement.

“ B ” 's infringing listings must be removed immediately to prevent damage to " A " brand and lost sales.

While " A " has many options available under this state. But we would prefer to resolve this matter amicably. Please confirm to us in writing within 24 hours, that you have:

(1) Removed all of " A’s " trademarks and copyright material from your Amazon.com listings and any other website or public display you operate;

(2) Removed all of " A’s " listings of products it claims to be associated with " A’s ", including but not limited to the ASINs listed above

Failure to take action within 24 hours will force us to report this serious violation to the Amazon seller performance team. This is licensed products to Amazon.com as well, Amazon seller performance team will take such violations very seriously, possibly resulting in removal of your selling privileges on Amazon.com.

(2)Test Buy及向AM投诉情况

投诉前的基本工作:商标已做GCID备案,最好有Test Buy Order ID

投诉方式:从 Amazon 后台 Contact Seller Support 开 case 投诉,Report a violation 

投诉链接入口:https://sellercentral.amazon.com/hz/contact-us(US站为例)

投诉邮件写法:先礼貌合理陈述内容;如果AM客服处理不积极,语气严肃,如果依旧没改进;以愤怒、强硬、不爆粗的态度再联系;


注意:

AM客服效率高,投诉收到回复,那就Ok; AM客服效率低,没有收到回复,关掉后重新发起Case投诉;

为了得到亚马逊客服的快速回应,投诉邮件要包含:ASIN、Seller ID、侵权状况简述(如果有Test order,还要包括Order ID、图片、差异说明等)

投诉邮件中不要提到“Trademark”or “Copyright”,否则会被转到Legal Department;

Test Buy之后不要留差评,否则可能会给Listing惹上麻烦;

对Test buy的order申请退货,要求对方负担运费和全额退款,如果对方有异议,直接开A-Z。


以上动作之后,如果经AM核实验证情况属实,会要求该仿冒者(跟卖)立即下架,且有可能会被要求退款给购买他产品的买家;但也有另种可能,得到的回复如下:Based on the information you provided in your complaint, we are unable to remove the items listed at the end of this message.(抱歉,我们没有办法帮您删除跟卖者的 Listings)遇到这种回复该怎么办呢?这时候可以以权利人身份进行投诉:


Amazon后台——Report Infringement

投诉链接入口:https://www.amazon.com/gp/help/reports/infringement(以US站为例)

无论是买家还是卖家,都可以在这个投诉入口,以权利人身份投诉。如果注册了商标,则这个入口的投诉成功率在9成左右。如果投诉失败,则可换一个亚马逊客服,重新开case投诉。


(3)被VE账号跟卖肿么办?

首先了解什么是VE卖家?

属于美国本土卖家,(或者拥有美国本土所注册的公司),有美国本土的收发货地址,以美国公司的名义,向亚马逊申请成为VE(Vendor Express)卖家,也即亚马逊平台的供应商,成为VE卖家的账户。

VE卖家可以选择把货物供给亚马逊,由亚马逊发货给客户,也可以选择自己在美国本土发货,但共同点是,他们的卖家信息处都会显示Sold by Amazon标识。


解决方法:

对于这种情况卖家可以通过发布时的UPC码,原产品图片,产品信息等等,向亚马逊客服申诉,投诉自己产品所遭遇恶意篡改。

多账号买跟卖者店铺其他的货;

尝试以律师事务所的地址为收件地址进行购买;

如果可能,直接发律师函(需要有Test Buy测试购买才行);

中文邮件直接警告:1、同是卖家,相煎何太急!2、以其人之道还治其人之身(我们可以通过招商经理、通过IP查到对跟卖联系方式等相关信息,同时可采取必要措施,表明事情的严重性,让对方知难而退!)
